{"id":2279,"date":"2020-09-10T14:55:59","date_gmt":"2020-09-10T14:55:59","guid":{"rendered":"https:\/\/dlaboral.co\/?p=2279"},"modified":"2020-09-10T14:59:09","modified_gmt":"2020-09-10T14:59:09","slug":"resena-sentencia-sl-2804-de-2020-pacto-de-salario-integral","status":"publish","type":"post","link":"https:\/\/dlaboral.co\/index.php\/2020\/09\/10\/resena-sentencia-sl-2804-de-2020-pacto-de-salario-integral\/","title":{"rendered":"Rese\u00f1a sentencia SL 2804 de 2020: Pacto de salario integral"},"content":{"rendered":"\n<p style=\"text-align: justify;\">\nEn sentencia SL 2804 de 2020, la Sala de Casaci\u00f3n Laboral de la Corte Suprema, analiz\u00f3 una vez m\u00e1s, el alcance de la formalidad establecida en el literal b) del art. 132 del C.S.T. modificado por el art. 18 de la ley 50 de 1990,&nbsp; para el establecimiento del denominado salario integral normal seg\u00fan la cual, esta modalidad de remuneraci\u00f3n debe pactarse por escrito.<\/p>\n\n\n\n<p style=\"text-align: justify;\">La Sala, precis\u00f3 lo que desde la Teor\u00eda del Negocio Jur\u00eddico (y de <em>lege lata<\/em>, conforme el art. 1500 del C.C<em>.) <\/em>es obvio, que las cuando el legislador prescribe la forma <em>ad solemnitatem (o ad substantiam actus) <\/em>&nbsp;lo hace con car\u00e1cter obligatorio, como un elemento esencial, de manera que si se omite, el acto no nace y, por tanto, no crea derechos ni obligaciones entre las partes.<\/p>\n\n\n\n<p style=\"text-align: justify;\">Con ese orden de ideas, la Corte recogi\u00f3 la doctrina plasmada, entre otras, en las sentencias CSJ SL, 9 ag. 2011, rad. 40259, reiterada en CSJ SL, 28 feb. 2012, rad. 37592, CSJ SL4235-2014 y CSJ SL4594-2016 en las cuales hab\u00eda sostenido que el pacto de salario integral <em>\u00ab<u>puede desprenderse de la conducta<\/u> asumida por las mismas <\/em>[partes]<em> durante la ejecuci\u00f3n del contrato de trabajo\u201d <\/em>dando un alcance relativo a la solemnidad que el legislador estableci\u00f3 como sustancial: el pacto escrito.<\/p>\n\n\n\n<p style=\"text-align: justify;\">En suma, la Corte rectifica su jurisprudencia en el sentido que los actos formales del Derecho del Trabajo como el contrato a t\u00e9rmino fijo, el acuerdo de salario integral o periodo de prueba, inexorablemente, no solo deben constar por escrito para su existencia (formalidad <em>ad substantiam actus<\/em> o <em>ad solemnitatem<\/em>) sino que su prueba no puede suplirse por un medio distinto al acto de constituci\u00f3n (formalidad <em>ad probationem<\/em>).<\/p>\n\n\n\n<p style=\"text-align: justify;\">Para este tipo de acuerdos, entonces, no es posible predicar un acuerdo de voluntades que no se materialice en la solemnidad escrita establecida por el legislador.<\/p>\n\n\n\n<p><em>Corte Suprema.
